O2 say you cannot downgrade from the £45p/m tarrif Untill 3 months.

Even though it states no time restrictions in their contract.

Now most of us want to go to lower tarrifs. O2 are in breach of contract they are imposing a unstated clause. We as customers have right of way WE WILL NOT LET O2 RIP US OFF!

It's important to check the paperwork, if it says on the paperwork you have agreed to pay £45 ech month for 12 months they can hold you to it.

BTW,
On CPW Orange contracts, the paperwork DOES NOT state a particular monthly amount.

I agree with pachy here, on the contract which we signed it says we are agreeing to pay £45 for 12 months. There is nothing in the contract or on the terms and conditions that say we can downgrade either so they can actually make us pay for 12 months @ of £45. Then since oral contracts are as valid as written ones we can challenge that saying the sales man/girl told us we could downgrade after three months, if they actually said so. I know in some of our cases the salesman/girl said we can downgrade straight away so I think those people can challenge o2 for breach or contract. What you think

I'd love to but I plan on downgrading after 3 months anyway. Thats what time frame I was told when I bought it and thats when the free texts bundle that came with it as a special offer runs out. It's gonna save me money in the long run (my girlfriend is on O2 and ringing from Vodafone can be expensive) so I'm happy down grading after the 3 months. Maybe I'll even keep it and get rid of my Vodafone

I think if you read Vermania's original post O2 haven't said he can't down grade after 3 months... they said he can't downgrade until the 3 months is up... then he can do what he wants

THE CONTRACT DOES NOT STATE THE TARIFF THAT YOU HAVE TO STAY ON!!!!

it says 12 months but not mention of the tariff. It says nothing about the 3 MONTHS before changing contract thingy.

I am writing to oftel......its not a big amount but 02 cant mess us around (even though we can mess them around )

Tommorrow they may change their "verbal" policy and say 6 months before you can change a contract but unless its written it has no value.

I suggest we all write to oftel individually for the maximum impact

I agree, but what I was saying were, if we are challenging it now saying they should allow us to downgrade now then they could actually take a retaliatory action and ask us to pay £45 for the whole year since there is nothing in the contract against it.

Some sellers play a dangerous game, they will go ahead & let you downgrade say from £45 to £15, then they will send you a bill for the amount you WOULD have paid for the phone if you had bought it on a £15 a month contract.

I don't have the paper work right with me, since I am at work now, but I am quite sure on the document I signed, which has the Terms and conditions on the back, it is mentioned on the top right hand side 'On £45, 400 minute x network contract, 400 text messages etc.

If your contract don't have it then there is a chance that they changed the contract recently (may be they came to know about this scam) since I took the contract on the saturday the 6th and they printed the contract from their website. So their is a good chance it may have been updated very recently.

PS:Don't think I am against complaining to oftel, I am more than happy to send a letter. I think if we talk about this we will be more prepared

PPS: Could any one confirm after looking on the contract whether the tariff is written there or is it only on mine

Just a note about verbal contracts. Under Scottish law a verbal contract between two people that is shook upon and witnessed by a third party is legally binding. The same does not apply under English law, which is the law used by the networks.

P.S. It is also Scots law that one must allow someone to use one's lavatory if so requested, even if the person is a complete stranger. Not very enforceable I would imagine.
